I would suggest looking through your employement contract and clarifying the rules with your HR/Employer. Some places require you to pay back the salary you were paid during mat leave and because you might not be serving your notice period it can mean added money you might have to pay. Each company is different and has certain policies in place that are diff to others. Talking to your employer/hr would be best to make an informed decision

Hi Natsvan

This is the way I see it: they would already have made provision while you are on maternity leave, so that will either continue or they can find someone else.

One of my friends and colleagues resigned while she was on maternity, like a week or so before she was due to come back and nothing changed. she just didn't come back. So I would say yes, depending on your employer, but u would think its a bit weird to go back just to work for a month or however long your notice period is.

Good luck.

Hi Natsvan,

The Basic conditions of employment act does not allow for leave to be taken during a notice period. I would assume that includes maternity leave. You will therefore probably need to go back and work your notice period. Also, what does your Employment policy state? With us, we get paid maternity leave but if you resign within 4 months after that, you need to pay back your salary received for that time.

Having said all of this, everything is always dependant on your employer goodwill. Maybe you can negotiate a lesser notice period with them?

Good luck!

Hi Natsvan,

You can still claim uif if you resign while pregnant. I'm not sure what happens to notice period but the best would be to discuss ot with your employer.
Good luck!

Hi Mommies

Does anyone know what happens if I resign while on maternity leave? What happens with the notice period? Would I have to go in and work my notice period of one month?
I see I can still claim 4 months maternity UIF even if I have resigned.

TIA
