She has worked for me since 1 July 2010 - but even then she knew that she is only on contract and that her employment is not permanent? Does that still mean that even if she was aware that her service would end 14 Dec - I must still pay her retrenchment package?

Ja - I have her contract printed (which she refused to sign). I am going to pay her tomorrow afternoon for monies due till 14 Dec. There is no bonus and she has no leave days due (she actually OWES me leave)..
I also thought I would give her the R180 for Dr back.. and will let her sign it all. ..

Ugggh... WHY does it always have to be so friggin difficult and full of drama with them?

Charmi- if the agreement was that she leaves on 14th Dec as long as you pay her to that date she can not take you to CCMA and yes her uif must be paid up. How long has she worked for you? She might have a claim for a retrenchment package which is 1 week for every year worked.

Kerry- buy some Reuterina tabs and take dbl dose of those. It is safe in pregnancy and will sort any imbalance out

yeah, its definately gonna end there... and the other fear i would have between now and then is if she's prepared to lie about the doctor to get money out of you she's probably prepared to steal to take what she believes is due to her too... i know how you feel and to be honest i wouldn't want her present anymore.

But all you can do is pay her to 14 December as agreed and any december bonus you usually give and don't allow her back in your house...

And of course keep proof that you paid her, coz i am sure she will argue that too!

Just feel bad as this is suppose to be our "happy place" with baby news Know what I mean? I keep hoping that some miracle labour specialist-mrs-know-it-all will read this & tell me what is the correct way to get rid of this woman asap...

The last thing I have energy for now is a CCMA hearing... and I can guarantee it's going to end up there...
